Tomble Ltd. is a private limited company, registered in England and Wales under the number 12376419, headquartered in London, 86-90 Paul Street, EC2A 4NE
The donor can select one or more charities to support during the checkout process. The donation will be transmitted to the selected charity/ charities after the donation is made to Tomble Ltd. If the donor select multiple charities, the total amount of the donation will be equally split in between the selected charities. The payments are managed by Pledgeling Technologies Inc. They monitor the payments and your donation is made to the Pledgeling Foundation, a US- tax- exempt 501c(3) organisation that is separate from Plegdeling Technologies Inc, that manages the software behind it. Pledgeling Foundation aggregates donations and regrants them to the recipient nonprofits.

The Sweepstake is strictly organized online on the website www.tomble.org ('the Site').
Every individual, as specified in article 8.1 that participates in a sweepstake by the methods specified in article 9.2.
6. Winning Donor
The Donor who is selected as the winning Donor, specified in the article 10.1, 10.2, 10.3 and 10.4.
7.1. The winner will receive the following package:

7.2. The Prize cannot be awarded in any form other than that provided for by these Terms & Conditions. The item or experience will not be taken back, exchanged, or replaced by any other object or experience for any cause. Prize may be subject to restrictions in certain jurisdictions based on availability, licensing, import or other distribution restrictions. It is the sole responsibility of the winner to evaluate the Prize and ensure that it satisfies all applicable standards and it meets the laws of the country of residence of the winner. The value of the Prize is provided on an “as is” basis without any representations and warranties whatsoever and can vary for each country. Prizes mentioned are “maximum budgets and cannot be raised. The value for experiences may vary depending on point of departure, travel dates and fare/rate fluctuations. Tomble Ltd. cannot be held responsible for any cancellations, delays, diversions problems, malfunctionings, accidents or substitutions or any act or omission of any third person with respect to the Prize.
7.3. This Sweepstake is not sponsored, endorsed, or affiliated in any way with the brands or the Charity involved in this Prize.
8. Terms of participation
8.1. The Sweepstake is open to any individual residing in a jurisdiction where the Sweepstake is permitted. The Donor must be of legal age of majority in his/ her jurisdiction of residence. Void where otherwise prohibited or restricted by law. All local laws and regulations apply. It is the responsibility of the Donor to review any specific local restrictions or laws before claiming a prize or making a donation.
8.2. Full-time and part-time employees, officers and Directors of Tomble Ltd. and members of their immediate families and households (i.e. parents, spouses, domestic partners, siblings and children), are not eligible to win.
8.3. Any registration of an incomplete invalidated Donor with false or fanciful indications and more generally not following the conditions set out in these Terms & Conditions will be considered null and void. The Donor undertakes to provide accurate, correct and complete information and to provide Tomble Ltd. with any updates regarding the personal data he has entered on the electronic registration form. Tomble Ltd. cannot be held liable due to a subsequent change of address of the Donor. The Donor undertakes not to use a pseudonym or email address that could infringe the rights of third parties (including by using the surname of a third party, the trademark of others or works protected by copyright, etc.). The Donor authorizes all legal checks regarding his identity and contact information. Any incomplete, false and/or incorrect identification or address results in the immediate elimination of the Donor concerned. In the event of an indication of false, erroneous, illegible, incomplete, inaccurate, fanciful or undiscounted identity, Tomble Ltd. reserves the right, without notice or prior information, to write off the Donor and cancel his tickets, without any recourse or action it may take against it. Under no circumstances can Tomble Ltd. be liable because of a Donor who would usurp the identity of others and/or any property right, which he would not hold in the sweepstake registration process.
9. The procedure of entering the Sweepstake
9.1. NO PURCHASE, PAYMENT OR CONTRIBUTION IS NECESSARY TO ENTER OR WIN.Contributing will not improve chances of winning.
9.2. One can enter a campaign by the following options

Each Donor has the option to donate for one of our charities and receive entries into the drawing with a minimal unit value of 0,0333... Euro. The Donor will be asked to fill out an online form specifying their surname, first name, address, postcode, city, country, email address, and, optionally, phone number.
- Enter the draw for free:
Everyone has the choice to enter the drawing for free and receive 50 chances, which is the equivalent of a paid donation of £5. The Donor will be asked to fill out an online form specifying their surname, first name, address, postcode, city, country, email address, and, optionally, phone number.
9.3. The capital of the Sweepstake has been set at the sum of 200.000 Pounds, consisting of 6.000.000 chances with a minimal unit value of 0,0333... Pound. Approximately 60% of the total capital is used to source and finance the Prize or experience, marketing, taxes and payment fees. The remaining 40% of the capital is split in half (20% of the total capital) to finance the organizational costs of Tomble Ltd, and the other half (20% of the total capital) goes to the charity.
9.4. The payment of the ticket is made online via a secure payment platform.
9.5. Once the payment has been made, the Donor will receive an email mentioning the ticket, the amount of entries and confirming his participation in the draw that will take place as stipulated.
10. Selection Process
10.1 The winning Donor will be chosen through a random selection process by Tomble Ltd. or its representative. Odds of winning depend on the number of entries held. The draw will take place within two weeks after the end of the campaign.
10.2.The draw of the Prize can only be made on the condition that all the entries are sold at the end of the campaign. If not all entries are sold at the end of the campaign, the draw will consist of a cash prize which will be the equivalent of the total sum of the collected funds raised by Tomble Ltd, excluding the costs of marketing, taxes and payment fees, excluding 20% for charity and 20% for Tomble Ltd.
10.3 A confirmation process, which may include a background check, will then take place to ensure the potential winner meets the legal standards required. Winner and, if applicable,
their guest(s) agree to cooperate fully with Tomble Ltd. in conducting any background check(s), which includes providing information requested by Tomble Ltd. In the specific case of an experience, meeting a celebrity, meeting a public figure, or attending a special event and any background check indicates, that the potential winner or the potential winner’s guest(s) might pose a danger to or may harm the reputation of any person or entity involved in the sweepstakes, Tomble Ltd. may disqualify said winner and move on to the next randomly drawn potential winner. The background checks are done in the sole discretion of Tomble Ltd. Pending a positive outcome of the confirmation process, Tomble Ltd. representative will notify the potential winner via email and/or phone. The potential winner must respond within the time period designated in the notification, or Tomble Ltd. may move on to another randomly drawn potential winner. Before confirming a potential winner as the winner, Tomble Ltd. may require the potential winner to confirm their eligibility. Travel companions are also required to sign a liability/publicity release prior to issuance of tickets. Additionally, travel companions/guests of the winner may be subject to a background check, which may impact their ability to participate in the Prize.
The winning Donor and guest must travel on the same itinerary. The winning donor and guest will treat the employees of Tomble Ltd and our partners politely and respectfully. If this is not the case, Tomble Ltd reserves the right to cancel the prize at any moment and draw a new winner (in the case the prize has not yet been delivered).
10.4. It is the responsibility of the winning Donor to pay the subsequent taxes for the Prize if demanded in the country of his/ hers residence.
11.1. Any fraud or attempted fraud in this transaction by a Donor will result in the elimination of the Donor concerned and the cancellation of his entries, without prejudice to the other penalties provided by the Common Law.
12. Personal data.
12.2. By accepting the Prize, the winning Donor agrees that Tomble Ltd. can use his/hers name, location, photographs and videos with the Prize or during the experience, voices and/ or other likeness and Prize information for marketing and promotional purposes in any form of media, without any additional compensation.
13. Special constraints related to the Internet that may affect participation in the Sweepstake
13.1 Participation in the Sweepstake involves the knowledge and acceptance by any Donor of the characteristics and limitations of the Internet, including functional characteristics, technical performance, problems related to connection and/or access to the Internet and/or Site, network availability and clutter, network failure or saturation, transit time, access to information posted online, response times to view, view, question or otherwise transfer data, the risk of interruption, the lack of protection of certain data against possible hijacking or hacking and the risk of contamination by possible viruses circulating on the network for which Tomble Ltd. cannot be held responsible.
13.2. Tomble Ltd. cannot be held responsible for: delays or errors in the transmission of data that are beyond its control, sending an email or correspondence to an erroneous or incomplete or incomplete email or physical address, In case one or more Donors cannot connect to the Site due to any technical defects or problems related to network congestion, if, for any reason, the Donor's connection to the Site was to be interrupted or if its participation was not taken into account because of maintenance or malfunction of the Sweepstake's servers, online payment platform, telephone line or any other technical connection.
13.3 Furthermore, Tomble Ltd. cannot be held responsible for any damage, of any kind, caused to the Donors, their computer equipment and the data stored there, and the consequences that may result on their personal, professional or commercial activity.
13.4. The connection of any person to the Site and participation in the Sweepstake is under their full responsibility. It is therefore up to any Donor to take all appropriate measures in order to protect his own data and/or software stored on his computer equipment from any infringement due to acts of external malice, including viruses.
13.5 In all cases, if the proper administrative and/or technical process the operation is disrupted by a virus, computer bug, unauthorized human intervention or any other cause beyond Tomble Ltd. 's control, Tomble Ltd. reserves the right to interrupt the operation.
14. Cancellation or Changements
14.1 Tomble Ltd. may, if circumstances require it, shorten it, extend it, change its terms or change the location of the draw without any liability being incurred as a result.
14.2 In particular, the Tomble Ltd. may cancel or suspend all or part of the transaction if it appears that fraud has taken place in any form, including in the context of participation in the Sweepstake and/or in the event of a misinformation by the Donors. It reserves, in this case, the right not to award the endowment to the fraudster (s) and/or to prosecute him in the competent courts.
15. Intellectual property rights.
15.1. The Site, elements of any kind be it components of the Site, the graphic chartre of the Site, the trademarks and logos are the exclusive property of Tomble Ltd. or its partners who hold all the rights to intellectual and industrial property. Any reproduction, representation, adaptation and/or exploitation, total or partial, of the Site are strictly prohibited, without written prior permission from Tomble Ltd.. Tomble Ltd. grants a free, personal, non-exclusive and non-transferable right to access and use the Site for the purposes of the Sweepstake.
15.2. Evidence, Conservation and Archive. Computerized records, including emails, kept in the systems of Tomble Ltd. (or its duly authorized service providers) will be considered as systems of record. It is agreed that in the event of a discrepancy between Tomble Ltd.'s computerized registers or its providers and the paper or electronic documents available to the Donor, the computerized records of Tomble Ltd. will prevail.
16. Rule Changes
16.1. Additives and regulatory changes that may be made during the duration of the transaction within limits set out in the Order authorizing the Sweepstake (or any new orders made later about the Sweepstake) will be published on Site. They will be considered endorsements to this Terms & Conditions that are in agreement with the latter. Donors are therefore advised to log on to the Site on a regular basis to learn about any changes to these Terms & Conditions.
16.2. Amendments to this Full Terms & Conditions are deemed to be accepted in the same terms as the original version of this regulation.
17. Applicable Law and Jurisdiction.
This regulation is governed by UK law. Any dispute or challenge relating to the performance or interpretation of these Terms & Conditions will be submitted to the competent English Courts.
By entering the Sweepstake the Donor agrees:
- To be committed and to accept these Terms & Conditions and by all applicable laws and decisions.
- To renounce to any rights to claim ambiguity to these Terms & Conditions
- To renounce all of your rights to bring any claim, action or proceeding against any of the released parties in connection with the sweepstakes.
